کتاب وصیتوں کے مسائل کا بیان

The book of wasaya (wills and testaments).

سورۃ نساء میں اللہ تعالیٰ کا ارشاد کہ بیشک وہ لوگ جو یتیموں کا مال ظلم کے ساتھ کھا جاتے ہیں . . .

(23) CHAPTER. The Statement of Allah: “Verily, those who unjustly eat up the property of orphans, they eat up only fire into their bellies, and they will be burnt in the blazing Fire!” (V.4:10)

اللہ تعالیٰ کا سورۃ البقرہ میں یہ فرمانا کہ آپ صلی اللہ علیہ وسلم سے لوگ یتیموں کے بارے میں پوچھتے ہیں

(24) CHAPTER. Allah's Statement:

سفر اور حضر میں یتیم سے کام لینا جس میں اس کی بھلائی ہو اور ماں اور سوتیلے باپ کا یتیم پر نظر ڈالنا

(25) CHAPTER. The employment of an orphan on a journey and at home, provided it is beneficial for him. And (it is obligatory) for the mother and the stepfather of an orphan to look after him (even if they were not his guardians).

اگر کسی نے ایک زمین وقف کی ( جو مشہور و معلوم ہے ) اس کی حدیں بیان نہیں کیں تو یہ جائز ہو گا ‘ اسی طرح ایسی زمین کا صدقہ دینا

(26) CHAPTER. If somebody gives a piece of land as an endowment and does not mark its boundaries, the endowment is valid. The same is applied to objects of charity.

اگر کئی آدمیوں نے اپنی مشترک زمین جو مشاع تھی ( تقسیم نہیں ہوتی تھی ) وقف کر دی تو جائز ہے

(27) CHAPTER. If a group of person give a jointly-owned piece of land as an endowment, the foundation of the endowment is valid.

وقف کی سند کیوں کر لکھی جائے

(28) CHAPTER. How to write the endowment?

مالدار محتاج اور مہمان سب پر وقف کر سکتا ہے

(29) CHAPTER. The usufruct of an endowment may be spent for the wealthy, the poor and the guests.

مسجد کے لئے زمین کا وقف کرنا

(30) CHAPTER. The foundation of an endowment of a piece of land for building a mosque.

جانور اور گھوڑے اور سامان اور سونا چاندی وقف کرنا

(31) CHAPTER. Giving animals; particularly horses and property and gold and silver as endowments.

وقف کی جائیداد کا اہتمام کرنے والا اپنا خرچ اس میں سے لے سکتا ہے

(32) CHAPTER. The salary of the administrator of an endowment.

کسی نے کنواں وقف کیا اور اپنے لئے بھی اس میں سے عام مسلمانوں کی طرح پانی لینے کی شرط لگائی ۔ ۔ ۔

(33) CHAPTER. If somebody keeps a piece of land or a well as an endowment, or stipulates that he should benefit by its water as the other Muslims do (will this be permissible)?

اگر وقف کرنے والا یوں کہے کہ اس کی قیمت اللہ ہی سے لیں گے تو وقف درست ہو جائے گا

(34) CHAPTER. It is permissible for the founder of an endowment to say, “We will demand its price, from none but Allah.”

( سورۃ المائدہ میں ) اللہ تعالیٰ کا یہ فرمانا مسلمانو ! جب تم میں کوئی مرنے لگے توآپس کی گواہی ۔ ۔ ۔

(35) CHAPTER. The Statement of Allah: O you who believe! When death approaches any of you, and you make a bequest, (then take) the testimony of two just men of your own folk or two others from outside ... (up to) ... Allah guides not the people who are Al-Fasiqun (the rebellious and disobedient). (V.5:106-108)

میت پر جو قرضہ ہو وہ اس کا وصی ادا کر سکتا ہے گو دوسرے وارث حاضر نہ ہوں

(36) CHAPTER. The payments of the debts of the deceased by the executor (of the will) in the absence of other inheritors.
