(71) CHAPTER. It is forbidden to meet the caravans on the way (to buy the goods away from the market). پہلے سے آگے جا کر قافلے والوں سے ملنے کی ممانعت اور یہ بیع رد کر دی جاتی ہے

حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ ، حَدَّثَنَا عَبْدُ الْوَهَّابِ ، حَدَّثَنَا عُبَيْدُ اللَّهِ الْعُمَرِيُّ ، عَنْ سَعِيدِ بْنِ أَبِي سَعِيدٍ ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : نَهَى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ التَّلَقِّي ، وَأَنْ يَبِيعَ حَاضِرٌ لِبَادٍ .
Narrated Abu Huraira: The Prophet forbade the meeting (of caravans) on the way and the selling of goods by an inhabitant of the town on behalf of a desert dweller.
ہم سے محمد بن بشار نے بیان کیا، کہا کہ ہم سے عبدالوہاب نے بیان کیا، ان سے عبیداللہ عمری نے بیان کیا، ان سے سعید بن ابی سعید نے اور ان سے ابوہریرہ رضی اللہ عنہ نے کہ نبی کریم صلی اللہ علیہ وسلم نے ( تجارتی قافلوں سے ) آگے بڑھ کر ملنے سے منع فرمایا ہے اور بستی والوں کو باہر والوں کا مال بیچنے سے بھی منع فرمایا۔

حَدَّثَنِي عَيَّاشُ بْنُ الْوَلِيدِ ، حَدَّثَنَا عَبْدُ الْأَعْلَى ، حَدَّثَنَا مَعْمَرٌ ، عَنِ ابْنِ طَاوُسٍ ، عَنْ أَبِيهِ ، قَالَ : سَأَلْتُ ابْنَ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُ ، مَا مَعْنَى قَوْلِهِ : لَا يَبِيعَنَّ حَاضِرٌ لِبَادٍ ؟ فَقَالَ : لَا يَكُنْ لَهُ سِمْسَارًا .
Narrated Tawus: I asked Ibn `Abbas, What is the meaning of, 'No town dweller should sell (or buy) for a desert dweller'? Ibn `Abbas said, It means he should not become his broker.
مجھ سے عیاش بن عبدالولید نے بیان کیا، کہا کہ ہم سے عبدالاعلیٰ نے بیان کیا، کہا کہ ہم سے معمر نے بیان کیا، ان سے ابن طاؤس نے، ان سے ان کے باپ نے بیان کیا کہ میں نے ابن عباس رضی اللہ عنہما سے پوچھا کہ نبی کریم صلی اللہ علیہ وسلم کے اس ارشاد کا مطلب کیا ہے کہ کوئی شہری کسی دیہاتی کا مال نہ بیچے؟ تو انہوں نے کہا کہ مطلب یہ ہے کہ اس کا دلال نہ بنے۔

حَدَّثَنَا مُسَدَّدٌ ، حَدَّثَنَا يَزِيدُ بْنُ زُرَيْعٍ ، قَالَ : حَدَّثَنِي التَّيْمِيُّ ، عَنْ أَبِي عُثْمَانَ ، عَنْ عَبْدِ اللَّهِ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : مَنِ اشْتَرَى مُحَفَّلَةً فَلْيَرُدَّ مَعَهَا صَاعًا ، قَالَ : وَنَهَى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ تَلَقِّي الْبُيُوعِ .
Narrated `Abdullah: Whoever buys an animal which has been kept unmilked for a long time, could return it, but has to pay a Sa of dates along with it. And the Prophet forbade meeting the owners of goods on the way away from the market.
ہم سے مسدد نے بیان کیا، کہا کہ ہم سے یزید بن زریع نے بیان کیا، کہ ہم سے تیمی نے بیان کیا، ان سے ابوعثمان نے اور ان سے عبداللہ بن مسعود رضی اللہ عنہ نے بیان کیا کہ جو کوئی دودھ جمع کی ہوئی بکری خریدے ( وہ بکری پھیر دے ) اور اس کے ساتھ ایک صاع دیدے اور نبی کریم صلی اللہ علیہ وسلم نے قافلہ والوں سے آگے بڑھ کر ملنے سے منع فرمایا۔

حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ ، أَخْبَرَنَا مَالِكٌ ، عَنْ نَافِعٍ ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : لَا يَبِيعُ بَعْضُكُمْ عَلَى بَيْعِ بَعْضٍ ، وَلَا تَلَقَّوْا السِّلَعَ حَتَّى يُهْبَطَ بِهَا إِلَى السُّوقِ .
Narrated `Abdullah bin `Umar: Allah's Apostle said, You should not try to cancel the purchases of one another (to get a benefit thereof), and do not go ahead to meet the caravan (for buying the goods) (but wait) till it reaches the market.
ہم سے عبداللہ بن یوسف نے بیان کیا، کہا کہ ہم کو امام مالک رحمہ اللہ نے خبر دی، انہیں نافع نے اور انہیں عبداللہ بن عمر رضی اللہ عنہما نے کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا کوئی شخص کسی دوسرے کی بیع پر بیع نہ کرے اور جو مال باہر سے آ رہا ہو اس سے آگے جا کر نہ ملے جب تک وہ بازار میں نہ آئے۔

(1) CHAPTER. What has come in the Statement of Allah: Then when the (Jumuah) SaIat is ended, you may disperse through the land, and seek of the Bounty of Allah... And Allah is the Best of Providers. (V.62:10,11) And also His Statement: Eat not up your property among yourselves unjustly except it be a trade among yourselves unjustly except it be a trade amongst you, by mutual consent... (V.4:29)
اللہ تعالیٰ کے اس ارشاد سے متعلق احادیث کہ

اللہ تعالیٰ کا ( سورۃ الجمعہ میں ) یہ فرمانا کہ جب وہ مال تجارت آتا ہوا یا کوئی اور تماشہ دیکھتے ہیں تو اس کی طرف دوڑ پڑتے ہیں ۔

(57) CHAPTER. If somebody buys some goods or (an) animal and let it with the seller, or it dies before he takes it into his possession.
اگر کسی شخص نے کچھ اسباب یا ایک جانور خریدا اور اس کو بائع ہی کے پاس رکھوا دیا اور وہ اسباب تلف ہو گیا یا جانور مر گیا اور ابھی مشتری نے اس پر قبضہ نہیں کیا تھا

(58) CHAPTER. A seller should not urge somebody (in case of optional sale) to cancle a bargain the latter has already agreed upon with another seller so as to sell him his own goods; and a buyer should not urge the seller to cencle a barbain already agreed upon with another buyer so as to buy the goods himself, unless they are given permission in both cases, or the bargains are cancelled with the willingness of both the seller and the buyer.
کوئی مسلمان اپنے کسی مسلمان بھائی کی بیع میں دخل اندازی نہ کرے اور اپنے بھائی کے بھاؤ لگاتے وقت اس کے بھاؤ کو نہ بگاڑے جب تک وہ اجازت نہ دے یا چھوڑ نہ دے

(60) CHAPTER. An-Najsh and whoever said: A bargain carried out in such a way (Najsh) is not valid.

(64) CHAPTER. The seller is not allowed to keep camels, cows, sheep or any other animal unmilked for a long time (so as to get more price by cheating).
اونٹ یا بکری یا گائے کے تھن میں دودھ جمع کر رکھنا بائع کو منع ہے

(65) CHAPTER. The option of returning an animal after milking it, along with a Sa of dates (as the price of the milk), if it has been kept unmilked for a long period by the seller (to deceive others).
خریدار اگر چاہے تو مصراۃ کو واپس کر سکتا ہے لیکن اس کے دودھ کے بدلہ میں ( جو خریدار نے استعمال کیا ہے ) ایک صاع کھجور دے دے
