(15) CHAPTER. To bear witness as to the writer of a stamped letter. مہری خط پر گواہی دینے کا بیان

Chapter 15 of The book of al-ahkam (judgements). in Sahih Bukhari. Each Hadith below carries its Arabic text, its Urdu and English translation, its number and its grading.

حَدَّثَنِي مُحَمَّدُ بْنُ بَشَّارٍ ، حَدَّثَنَا غُنْدَرٌ ، حَدَّثَنَا شُعْبَةُ ، قَالَ : سَمِعْتُ قَتَادَةَ ، عَنْ أَنَسِ بْنِ مَالِكٍ ، قَالَ : لَمَّا أَرَادَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ يَكْتُبَ إِلَى الرُّومِ ، قَالُوا : إِنَّهُمْ لَا يَقْرَءُونَ كِتَابًا إِلَّا مَخْتُومًا ، فَاتَّخَذَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ خَاتَمًا مِنْ فِضَّةٍ كَأَنِّي أَنْظُرُ إِلَى وَبِيصِهِ وَنَقْشُهُ ، مُحَمَّدٌ رَسُولُ اللَّهِ .
Narrated Anas bin Malik: When the Prophet intended to write to the Byzantines, the people said, They do not read a letter unless it is sealed (stamped). Therefore the Prophet took a silver ring----as if I am looking at its glitter now----and its engraving was: 'Muhammad, Apostle of Allah'.
مجھ سے محمد بن بشار نے بیان کیا، کہا ہم سے غندر نے بیان کیا، ان سے شعبہ نے بیان کیا، کہا کہ میں نے قتادہ سے سنا، ان سے انس بن مالک رضی اللہ عنہ نے بیان کیا کہ جب نبی کریم صلی اللہ علیہ وسلم نے اہل روم کو خط لکھنا چاہا تو صحابہ نے کہا کہ رومی صرف مہر لگا ہوا خط ہی قبول کرتے ہیں۔ نبی کریم صلی اللہ علیہ وسلم نے چاندی کی ایک مہر بنوائی گویا میں اس کی چمک کو اس وقت بھی دیکھ رہا ہوں اور اس پر کلمہ «محمد رسول الله‏.‏» نقش تھا۔

(1) CHAPTER. The Statement of Allah: “(O you who believe!) Obey Allah and obey the Messenger (Muhammad (p.b.u.h.)) and those of you (Muslims) who are in authority… (V.4:59)
اللہ تعالیٰ نے سورۃ نساء میں فرمایا کہ

(2) CHAPTER. The (chief) rulers (of all Muslims must be) from the Quraish.
امیر اور سردار اور خلیفہ ہمیشہ قریش قبیلے سے ہونا چاہئے

(3) CHAPTER. The reward of the person who judging according to (the principles of) Al-Hikmah.
جو شخص اللہ کی عطا کردہ حکمت کے ساتھ فیصلہ کرے ۔

(4) CHAPTER. To listen to and obey one's Imam (Muslim ruler) as long as his orders involve not one in disobedience (to Allah).
امام اور بادشاہ اسلام کی بات سننا اور ماننا واجب ہے جب تک وہ خلاف شرع اور گناہ کی بات کا حکم نہ دے

(5) CHAPTER. If somebody does not seek authority of ruling, then Allah will surely help him (if he is given such authority).
جسے بن مانگے سرداری ملے تو اللہ اس کی مدد کرے گا

(6) CHAPTER. He who seeks to be a ruler will be held responsible for that (i.e., Allah will not help him in his duty).
جو شخص مانگ کر حکومت لے اس کو اسی کے سپرد کر دیا گیا

(8) CHAPTER. If somebody is assigned the authority of ruling some people but, he does not look after them in an honest manner!
حکومت اور سرداری کی حرص کرنا مکروہ ہے

(9) CHAPTER. Whoever puts the people into troubles and difficulties will be put into troubles and difficulties by Allah.
جو شخص بندگان خدا کو ستائے ( مشکل میں پھانسے ) اللہ اس کو ستائے گا ( مشکل میں پھنسائے گا )

(10) CHAPTER. To give judgements and legal opinions on the road.
چلتے چلتے راستہ میں کوئی فیصلہ کرنا اور فتویٰ دینا

(11) CHAPTER. It is mentioned that there was no gatekeeper for the Prophet (p.b.u.h.).
یہ بیان کہ نبی کریم صلی اللہ علیہ وسلم کا کوئی دربان نہیں تھا

(12) CHAPTER. A governor (of a province, etc.,) who is under can sentence to death a person who deserve such punishement without consulting the Imam.
ماتحت حاکم قصاص کا حکم دے سکتا ہے بڑے حاکم سے اجازت لینے کی ضرورت نہیں

(13) CHAPTER. Can a judge give a judgement or a formal legal opinion while he is in an angry mood?
قاضی کو فیصلہ یا فتویٰ غصہ کی حالت میں دینا درست ہے یا نہیں

(14) CHAPTER. Whosoever thinks that a judge can give judgements for the people according to his knowledge if he is not afraid of being suspected or blamed.
قاضی کا اپنے ذاتی علم کی رو سے معاملات میں فیصلہ دینا درست ہے

(19) CHAPTER. Whoever passed a judgement in the mosque and when the actual legal punishement was to be put to action,he ordered the guilty person to be taken outside the mosque so that the punishment might be carried out.
حدکا مقدمہ مسجد میں سننا پھر جب حد لگانے کا وقت آئے تو مجرم کو مسجد کے باہر لے جانا

(20) CHAPTER. The advice of the Imam (ruler) to the litigants.

(21) CHAPTER. If a judge has to witness in favour of a litigant when he is a judge or he had it before he became a judge (can he pass a judgement in his favour accordingly or should he refer the case to another judge before whom he would bear witness?).
جب حاکم اعلیٰ دو شخصوں کو کسی ایک جگہ ہی کا حاکم مقرر کرے تو انہیں یہ حکم دے کہ وہ مل کر رہیں اور ایک دوسرے کی مخالفت نہ کریں

(22) CHAPTER. The order of the Wali (chief ruler) sending two Amir (governors) to one place that they should coopertae and agree with each other and should not differ with one another.

(30) CHAPTER. Judgement regarding cases involving wells, etc.
اگر کسی شخص کو حاکم دوسرے مسلمان بھائی کا مال ناحق دلا دے تو اس کو نہ لے کیونکہ حاکم کے فیصلہ سے نہ حرام حلال ہو سکتا ہے نہ حلال حرام ہو سکتا ہے

(31) CHAPTER. To judge (all) cases involving wealth weather it is much or little in amount, in one and the same.
کنویں اور اس جیسی چیزوں کے مقدمات فیصل کرنا

(32) CHAPTER. The selling of the people's real or personal estates by the ruler on their behalf.
ناحق مال اڑانے میں جو وعید ہے وہ تھوڑے اور بہت دونوں مالوں کو شامل ہے

(33) CHAPTER. Whoever does not care slanders made by ignorant people against the Amirs (leaders).
حکم ( بیوقوف اور غائب لوگوں کی جائیداد منقولہ اور غیر منقولہ دونوں کو بیچ سکتا ہے اور آنحضرت صلی اللہ علیہ وسلم نے ایک مدبر غلام بن نحام کے ہاتھ بیچ ڈالا

(34) CHAPTER. The one who is the most contentious of enemies; and that is, the most quarrelsome person of the opponents.

(35) CHAPTER. If a judge passes an unjust judgement or a judgement which differs from that of the learned religious men, such a judgement is to be rejected.
جب حاکم کا فیصلہ ظالمانہ ہو یا علماء کے خلاف ہو تو وہ رد کر دیا جائے گا

(36) CHAPTER. The Imam (ruler) going to some people to establish peace among them.
امام کسی جماعت کے پاس آئے اور ان میں باہم صلح کرادے

(37) CHAPTER. It is desirable that a scribe should be honest and wise.
