(22) CHAPTER. The refutation of the claim of those who say, All the legal decisions and verdicts given by the Prophet (p.b.u.h.) were apparent (i.e., known to all people). اس شخص کا رد جو یہ سمجھتا ہے کہ آنحضرت صلی اللہ علیہ وسلم کے تمام احکام ہر ایک صحابی کو معلوم رہتے تھے

حَدَّثَنَا مُسَدَّدٌ ، حَدَّثَنَا يَحْيَى ، عَنْ ابْنِ جُرَيْجٍ ، حَدَّثَنِي عَطَاءٌ ، عَنْ عُبَيْدِ بْنِ عُمَيْرٍ ، قَالَ : اسْتَأْذَنَ أَبُو مُوسَى عَلَى عُمَرَ فَكَأَنَّهُ وَجَدَهُ مَشْغُولًا ، فَرَجَعَ ، فَقَال عُمَرُ : أَلَمْ أَسْمَعْ صَوْتَ عَبْدِ اللَّهِ بْنِ قَيْسٍ ائْذَنُوا لَهُ فَدُعِيَ لَهُ ، فَقَالَ : مَا حَمَلَكَ عَلَى مَا صَنَعْتَ ، فَقَالَ : إِنَّا كُنَّا نُؤْمَرُ بِهَذَا ، قَالَ : فَأْتِنِي عَلَى هَذَا بِبَيِّنَةٍ أَوْ لَأَفْعَلَنَّ بِكَ ، فَانْطَلَقَ إِلَى مَجْلِسٍ مِنْ الْأَنْصَارِ ، فَقَالُوا : لَا يَشْهَدُ إِلَّا أَصَاغِرُنَا فَقَامَ أَبُو سَعِيدٍ الْخُدْرِيُّ ، فَقَالَ : قَدْ كُنَّا نُؤْمَرُ بِهَذَا ، فَقَالَ عُمَرُ : خَفِيَ عَلَيَّ هَذَا مِنْ أَمْرِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَلْهَانِي الصَّفْقُ بِالْأَسْوَاقِ .
Narrated 'Ubai bin `Umar: Abu Musa asked permission to enter upon `Umar, but seeing that he was busy, he went away. `Umar then said, Didn't I hear the voice of `Abdullah bin Qais? Allow him to come in. He was called in and `Umar said to him, What made you do what you did. He replied, We have been instructed thus by the Prophet `Umar said, Bring proof (witness) for this, other wise I will do so-and-so to you. Then `Abdullah bin Qais went to a gathering of the Ansar who then said, None but the youngest of us will give the witness for it. So Abu Sa`id Al-Khudri got up and said, We used to be instructed thus (by the Prophet). `Umar said, This tradition of the Prophet remained hidden from me. Business in the market kept me busy.
ہم سے مسدد بن مسرہد نے بیان کیا، کہا ہم سے یحییٰ بن سعید قطان نے بیان کیا، ان سے ابن جریج نے، ان سے عطاء بن ابی رباح نے، ان سے عبید بن عمیر نے بیان کیا کہ ہم سے مسدد بن مسرہد نے بیان کیا، کہا ہم سے یحییٰ بن سعید قطان نے بیان کیا، ان سے ابن جریج نے، ان سے عطاء بن ابی رباح نے، ان سے عبید بن عمیر نے بیان کیا کہ

حَدَّثَنَا عَلِيٌّ ، حَدَّثَنَا سُفْيَانُ ، حَدَّثَنِي الزُّهْرِيُّ ، أَنَّهُ سَمِعَهُ مِنَ الْأَعْرَجِ ، يَقُولُ : أَخْبَرَنِي أَبُو هُرَيْرَةَ ، قَالَ : إِنَّكُمْ تَزْعُمُونَ أَنَّ أَبَا هُرَيْرَةَ يُكْثِرُ الْحَدِيثَ عَلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، وَاللَّهُ الْمَوْعِدُ إِنِّي كُنْتُ امْرَأً مِسْكِينًا أَلْزَمُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَلَى مِلْءِ بَطْنِي ، وَكَانَ الْمُهَاجِرُونَ يَشْغَلُهُمُ الصَّفْقُ بِالْأَسْوَاقِ ، وَكَانَتْ الْأَنْصَارُ يَشْغَلُهُمُ الْقِيَامُ عَلَى أَمْوَالِهِمْ ، فَشَهِدْتُ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ذَاتَ يَوْمٍ ، وَقَالَ : مَنْ يَبْسُطْ رِدَاءَهُ حَتَّى أَقْضِيَ مَقَالَتِي ، ثُمَّ يَقْبِضْهُ فَلَنْ يَنْسَى شَيْئًا سَمِعَهُ مِنِّي ، فَبَسَطْتُ بُرْدَةً كَانَتْ عَلَيَّ ، فَوَالَّذِي بَعَثَهُ بِالْحَقِّ مَا نَسِيتُ شَيْئًا سَمِعْتُهُ مِنْهُ .
Narrated Al-A'raj: Abu Huraira said, You people claim that Abu Huraira narrates many narrations of Allah's Apostle. (Anyhow) with Allah will be our appointment. I was a poor man, and used to stick to Allah's Apostle contented with what will fill my stomach, and the Muhajirin (emigrants) used to be busy trading in the markets, and the Ansar used to be busy looking after their properties. One-day I heard Allah's Apostle saying, 'Who will spread his Rida' (a garment covering the upper part of the body) till I finished my speech and then fold it, (i.e. wrap it over your body), in which case he will never forget anything he had heard from me. So I spread my garment which I was wearing; and by Him Who sent Muhammad with the Truth, ever since, I have never forgotten whatever I heard from him (the Prophet) (See, Hadith No. 119, Vol. 1)
ہم سے علی بن عبداللہ مدینی نے بیان کیا، کہا ہم سے سفیان بن عیینہ نے کہا، مجھ سے زہری نے، انہوں نے اعرج سے سنا، انہوں نے بیان کیا کہ مجھے ابوہریرہ رضی اللہ عنہ نے خبر دی، انہوں نے کہا کہ تم سمجھتے ہو کہ ابوہریرہ رسول اللہ صلی اللہ علیہ وسلم کی بات زیادہ حدیث بیان کرتے ہیں، اللہ کے حضور میں سب کو جانا ہے۔ بات یہ تھی کہ میں ایک مسکین شخص تھا اور پیٹ بھرنے کے بعد ہر وقت نبی کریم صلی اللہ علیہ وسلم کے ساتھ رہتا تھا لیکن مہاجرین کو بازار کے کاروبار مشغول رکھتے تھے اور انصار کو اپنے مالوں کی دیکھ بھال مصروف رکھتی تھی۔ میں ایک دن نبی کریم صلی اللہ علیہ وسلم کی خدمت میں حاضر تھا اور آپ صلی اللہ علیہ وسلم نے فرمایا کہ کون اپنی چادر پھیلائے گا، یہاں تک کہ میں اپنی بات پوری کر لوں اور پھر وہ اپنی چادر سمیٹ لے اور اس کے بعد کبھی مجھ سے سنی ہوئی کوئی بات نہ بھولے۔ چنانچہ میں نے اپنی چادر جو میرے جسم پر تھی، پھیلا دی اور اس ذات کی قسم جس نے نبی کریم صلی اللہ علیہ وسلم کو حق کے ساتھ بھیجا تھا پھر کبھی میں آپ کی کوئی حدیث جو آپ سے سنی تھی، نہیں بھولا۔

دین کے مسائل میں رائے پر عمل کرنے کی مذمت ‘ اسی طرح بے ضرورت قیاس کرنے کی برائی

(8) CHAPTER. Whenever the Prophet (p.b.u.h.) was asked about something regarding which no Verse was revealed, he would either say, I do not know, or give no reply, but he never gave a verdict based on opinion or on Qiyas.
آنحضرت صلی اللہ علیہ وسلم نے کوئی مسئلہ رائے یا قیاس سے نہیں بتلا یا ۔

(9) CHAPTER. The way the Prophet (p.b.u.h.) taught his followers, whether men or women, of what Allah taught him.He did not impart his own opinions, nor did he give a verdict based on Qiyas.
رسول اللہ صلی اللہ علیہ وسلم کا اپنی امت کے مردوں وعورتوں کو وہی باتیں سکھا نا جو اللہ نے آپ کو سکھائی تھیں باقی رائے اور تمثیل آپ نے نہیں سکھائی ۔

(10) CHAPTER. The statement of the Prophet (p.b.u.h.), “A group of my followers will remain victorious in their struggle in the cause of the Truth.” Those are the religious learned men (i.e., Mujtahidun).
نبی کریم صلی اللہ علیہ وسلم کا ارشاد ” میری امت کی ایک جماعت حق پر غالب رہے گی اور جنگ کرتی رہے گی “

(11) CHAPTER. The Statement of Allah: “... or to cover you with confusion in party strife...” (V.6:65)
اللہ تعالیٰ کا سورۃ الانعام میں یوں فرمانا کہ یا وہ تمہارے کئی فرقے کر دے ۔

(12) CHAPTER. Whoever compares an ambiguous situation to a clear well-defined one, both of which have already been explained by the Prophet (p.b.u.h.) to make the questioner understand.
ایک امر معلوم کو دوسرے امر واضح سے تشبیہ دینا جس کا حکم اللہ نے بیان کر دیا ہے تاکہ پوچھنے والا سمجھ جائے

(13) CHAPTER. What has been said regarding exerting oneself to find out the proper legal verdict which is in harmony with what Allah has revealed.
قاضیوں کو کوشش کر کے اللہ کی کتاب کے موافق حکم دینا چائیے کیونکہ اللہ پاک نے فرمایا

(14) CHAPTER. The statement of the Prophet (p.b.u.h.), “Certainly you (Muslims!) will follow the ways of those who were before you (i.e., Jews and Christians).”
نبی کریم صلی اللہ علیہ وسلم کا یہ فرمان کہ اے مسلمانو ! تم اگلے لوگوں کی چال پر چلو گے

(15) CHAPTER. The sin of the person who invites others to an evil deed or establishes a bad tradition.
اس کا گناہ جو کسی گمراہی کی طرف بلائے یا کوئی بری رسم قائم کرے

(16) CHAPTER. The Prophet (p.b.u.h.) mentioned and recommended that the religious learned men should not differ. What common opinions the people of the two Haram (sanctuaries) of Makkah and Al-Madina had.
آنحضرت صلی اللہ علیہ وسلم نے عالموں کے اتفاق کرنے کا جو ذکر فرمایا ہے اس کی ترغیب دی ہے اور مکہ اور مدینہ کے عالموں کے اجماع کا بیان

(17) CHAPTER. The Statement of Allah: “Not for you (O Muhammad (p.b.u.h.), but for Allah) is the decision…” (V.3:128)
اللہ تعالیٰ کا فرمان سورۃ آلعمران میں کہ اے پیغمبر ! تجھ کو اس کام میں کوئی دخل نہیں آخر آیت تک ۔

(18) CHAPTER. The Statementof Allah: “...But, man is ever more quarrelsome than anything.” (V.18:54).
اللہ تعالیٰ کا ارشاد سورۃ الکہف میں ” اور انسان سب سے زیادہ جھگڑالو ہے “

(19) CHAPTER. The Statement of Allah: “Thus We have made you [true Muslims, --- real believers of Islamic Monotheism, true followers of Prophet Muhammad (p.b.u.h.) and his Sunna (legal ways)], a just (and the best) nation…” (V.2:143)
اللہ تعالیٰ کا ارشاد ” اور ہم نے اسی طرح تمہیں امت وسط بنا دیا ہے ۔

(20) CHAPTER. If a governor or a ruler gives a verdict based on his opinion and the verdict proves to be wrong and disagrees with the verdict of Allah's Messenger (p.b.u.h.), but he is unaware of that; then his verdict will be rejected.
حاکم کا ثواب ‘ جب کہ وہ اجتہاد کرے اور صحت پر ہو یا غلطی کر جائے ۔

(23) CHAPTER. Whoever thinks that if the Prophet (p.b.u.h.) did not disapprove of something (said or done in his presence), his silence indicated that it was permissible, but if another person faced a similar situation, his silence should not be taken as a sign of his agreement.
آنحضرت صلی اللہ علیہ وسلم سے ایک بات کہی جائے اور آپ اس پر انکار نہ کریں جسے تقریر کہتے ہیں تو یہ حجت ہے ۔ آنحضرت صلی اللہ علیہ وسلم کے سوا اور کسی کی تقریر پر حجت نہیں ۔

دلائل شرعیہ سے احکام کا نکالا جانا اور دلالت کے معنی اور اس کی تفسیر کیا ہو گی ؟

(27) CHAPTER. Something forbidden, by the Prophet (p.b.u.h.) is legally prohibited unless there is a proof that (later on) it was (made) legal. Similarly, his orders render things obigatory, as he said (to his Companions) when they finished their Ihram, Sleep with your wives.
نبی کریم صلی اللہ علیہ وسلم کسی چیز سے لوگوں کو منع کریں تو وہ حرام ہو گا مگر یہ کہ اس کی اباحت دلائل سے معلوم ہو جائے ۔

(28) CHAPTER. The Statement of Allah: “... And who (conduct) their affair by mutual consultation...” (V.42:38) … And consult them in the affair… (V.3:159)
اللہ تعالیٰ کا ( سورۃ شوریٰ میں ) فرمانا مسلمانوں کا کام آپس کے صلاح اور مشورے سے چلتا ہے
